ARIA License Terms v1.7
Version 1.7. Effective October 11, 2026. Language approved by April Harris and counsel October 11, 2026. Supersedes v1.6 for purchases and agreements on or after that date; families that accepted an earlier version remain under that version unless a counsel-approved mechanism applies v1.7.
ARIA License Terms
One Named Child and Device Use
Version 1.7. Effective October 11, 2026.
These License Terms govern use of a finished ARIA app supplied by Life in Victory LLC. The license belongs to the purchasing family for one named child in the ages 11-12 (under 13) or ages 13-18 product band. It allows the child to use ARIA on the devices permitted under Section 1.2, but it does not transfer ownership of ARIA software, templates, designs, or methods.
1. LICENSE GRANT
1.1 One Named Child. Provider grants the purchasing family a personal, limited, nonexclusive, nontransferable license for one named child's use.
1.2 Devices. Under an ARIA One-Time License, the named child may use ARIA on one device. Under an ARIA Subscription, the named child may use ARIA on multiple devices in the child's household, and there is no fixed device limit. Under either plan, the license may not be shared with another child, another household, a school population, or the public.
1.3 Separate Device Data. Each device maintains its own local journal and app data. Data does not automatically synchronize. The family may move or copy the child's data using an available backup file or QR-based second-device process.
1.4 Plan Duration. An ARIA One-Time License (formerly Own It) is perpetual after full payment. An ARIA Subscription (formerly All In) requires six paid months. After the family completes six paid months of ARIA Subscription, the named child keeps a continuing license to use the delivered app on household devices under Section 1.2 if the family later cancels. What ends at cancellation is the ongoing service, meaning upgrades and support under Sections 4.3 and 6; it does not end the child's continuing license to use the delivered app. Foundation does not include an ARIA app license unless expressly added.
2. OWNERSHIP
2.1 Family Content. The family owns the content the child or parent enters into ARIA.
2.2 Provider Materials. Life in Victory LLC and its licensors own ARIA software, code, interface designs, templates, modules, prompts, methods, documentation, branding, and reusable components.
2.3 License Not Sale. "Own It" means the family receives a perpetual right to use its delivered ARIA app. It does not mean the family acquires ownership of Provider Materials or the right to commercialize them.
3. PERMITTED AND PROHIBITED USE
3.1 Permitted Use. The family may use and reasonably personalize the delivered app for the named child, make personal backups, and use the devices permitted under Section 1.2 for that child.
3.2 Prohibited Use. The family may not sell, rent, sublicense, publish, redistribute, copy for another child or household, extract templates or reusable code, remove proprietary notices, reverse engineer protected components, or use ARIA to build or offer a competing product.
3.3 Contractors. A technician may assist the family solely to install, back up, or restore the child's licensed copy. The family remains responsible for the technician and may not provide access for copying, resale, template extraction, or unrelated development.
4. PERSONALIZATION AND UPGRADES
4.1 Build. Build covers the agreed personalization, configuration, and training preparation. Work outside the selected plan requires written approval and may require a separate quote.
4.2 Own It Support. Own It includes 90 days of email support. It does not include continuing upgrades after that period. A family may book a $95 working session; new features or substantial changes may require a quote.
4.3 All In Upgrades. Regular All In includes one upgrade per month. Founding All In includes up to four upgrades per month. Unused upgrades do not roll over unless Provider agrees in writing. An upgrade is a reasonable change to the existing app and does not include a new standalone application or major redevelopment.
5. PRIVACY AND SECURITY
5.1 On Device Design and Local AI Chat. ARIA keeps the child's app content on the household device. Provider does not operate a server database for the child's journal and does not collect app analytics, location, or the child's app content. The built in AI chat processes messages locally on the device. Chat messages are not sent to Provider, an external AI provider, or another server.
5.2 Family Control. The parent controls device access and may view or delete the local information. Provider cannot recover information it never received.
5.3 Backups. The family is responsible for backups and transfers. Local data may be permanently lost if storage is cleared or the device is lost, reset, repaired, replaced, or used in private-browsing mode.
6. THIRD-PARTY SERVICES
6.1 Parent Purchase, Intake, Booking, and Delivery. Stripe may process payment. GoHighLevel may process the parent completed intake form, email delivery, and booking widget. Web hosting, browser software, device operating systems, and optional domain services are provided by third parties under their own terms and privacy practices. The child may not complete the online intake or booking forms.
6.2 NotebookLM. Foundation may include configuration and training involving Google NotebookLM. Google controls that product. The parent is responsible for reviewing Google's terms, account requirements, and settings before allowing the child to use it.
7. DISCLAIMERS AND LIABILITY
7.1 No Professional Care. ARIA is not medical care, therapy, diagnosis, crisis monitoring, or emergency assistance.
7.2 Disclaimer. ARIA is provided as configured for the selected plan. Provider does not guarantee uninterrupted device or browser operation, preservation of local data, academic performance, health outcomes, or compatibility with future third-party changes.
7.3 Liability. To the maximum extent permitted by law, Provider's aggregate liability will not exceed the fees the family paid for the affected plan during the three months before the event; for a one-time plan, the cap is the amount paid for that plan. Provider is not liable for indirect, consequential, special, or punitive damages or lost data, profits, or opportunities.
8. TERMINATION AND GENERAL TERMS
8.1 Breach. Provider may terminate the license for material misuse, unauthorized sharing, resale, distribution, or infringement. If a curable breach occurs, Provider will provide ten days' written notice to cure when reasonably appropriate.
8.2 Effect. On termination for material misuse, unauthorized sharing, resale, distribution, infringement, or another breach of these Terms, the family must stop using the ARIA app and delete licensed Provider Materials and copies in its control, except records required by law. If the parent cancels an ARIA Subscription (formerly All In) after the family has completed six paid months, cancellation ends future subscription services, including upgrades and support, but does not end the named child's right to continue using the delivered ARIA app. Continued use does not transfer ownership of ARIA software, code, interface designs, templates, modules, prompts, methods, documentation, branding, or reusable components, and does not create continuing service rights.
8.3 Maryland Law and Venue. Maryland law governs. Court proceedings must be brought in a state court in Charles County, Maryland, or, if federal jurisdiction exists, the United States District Court for the District of Maryland.
8.4 Complete Terms. These Terms, the Parent Purchase and Consent Terms, Privacy Policy, and confirmed order are the complete agreement concerning family use. Changes must be in writing.
